1- APPLICATION OF THESE GENERAL TERMS AND CONDITIONS OF SALE

www.guillotwatches.com is an online shop owned and managed by Guillot SA Limited (hereinafter referred to as “the website”) whose registered office is located Avenue de Rothorn 11, 3960 Sierre, Switzerland (hereinafter referred to as “Guillot SA”).

The present General Conditions of Sale apply to all orders for articles or services offered by Guillot SA and placed via its website by the consumer, customer of the online shop (hereinafter referred to as “the customer or user”).

The customer must read the general conditions of sale before placing an order. These General Terms and Conditions are available on Guillot website.

Guillot SA reserves the right to modify these general conditions of sale at any time. The applicable general conditions of sale are those available on the website at the time of payment of the order. The customer must first have read, understood and accepted these general conditions of sale without reserve in order to finalize his order.

 

 

2- TERRITORIAL FIELD

Guillot watches, jewelry and accessories can be ordered to any country in the world provided that:

www.guillotwatches.com is an online sales website owned and managed by Guillot SA. The network is open to any user of the Internet network and, in principle, accessible 24/7, except interruption by Guillot SA or its service providers for reasons of maintenance or in case of force majeure. Guillot SA cannot be held responsible for any damage caused by the unavailability of the website.

 

 

4- ACCOUNT CREATION

In order to confirm an order, the user will be asked to create an account. Guillot SA will validate his registration after verification of the form filled by the customer. Once the registration has been validated, the customer will receive a confirmation of registration by email.

By registering on the Guillot website, the user declares and guarantees that he/she is of legal age and has the legal capacity to contract.

When creating an online account, the user must ensure that the information provided is accurate and complete. Guillot SA cannot be held responsible for the impossibility to deliver if the data provided are erroneous or incorrect. The user is obliged to constantly update the information concerning him.

Guillot SA also gives the possibility to the users of the website to connect thanks to the tool “Facebook connect “. If the customer is in possession of a “Facebook” account, it will be enough for him to click on the button provided for this purpose so that his information is filled automatically. The customer has the opportunity to view Facebook’s privacy policies directly on their website in order to learn more about the protection of personal data during their collection, processing and use as well as optional rights and settings to protect privacy.

Guillot SA is entitled to delete a user’s account at any time and at its sole discretion.

5- PRODUCTS

The Products offered for sale (hereinafter referred to as “Products”) are those present on the catalogue published on the pages of the online shop at the time of consultation of the website by the Customer and within the limits of available stocks.

Each Product is presented on the website in the most detailed way possible. Guillot SA attaches great importance to offering photographs as faithful as possible but cannot ensure perfect similarity with the Product offered, especially in terms of color rendering, material, dial reflection. All images should be considered only as illustrations and cannot, in any case, guarantee the appearance or technical characteristics.

Guillot SA may update Product information, images or prices at any time without notice.

Some fixing systems cannot be sold separately and are only available in a box, sold together with another Product from the catalogue. The detailed content of these boxes is available in the Product catalogue available on the website.

If certain characteristics are not present on the website, the Customer is entitled to request, by e-mail or by post, details from the customer service whose contact details are available in the article 17 below.

It is possible that the Customer receives following an order a part previously returned by another person. It is specified that Guillot SA accepts only the return of intact and unworn Products, these two conditions being controlled before the Product is put back in stock.

 

 

6- REFUSAL TO PROCESS AN ORDER

Guillot SA reserves the right to remove any Product posted on the website at any time and to modify or replace any content or information about it. Guillot SA attaches great importance to customer satisfaction but may refuse to process an order after sending the Customer an order confirmation by email.

Guillot SA shall not be held liable to the Customer or any third party for the harmful consequences of withdrawing a Product from the website, modifying or replacing any content or information whatsoever appearing on the website. Similarly, Guillot SA cannot be held responsible for refusing to process an order after sending the Customer an order confirmation by email.

Guillot SA also reserves the right to refuse or cancel an order from a Customer or a third party with whom it has a dispute over payment of another order.

7- PRICE

The prices indicated on Guillot SA’s website are in Swiss Francs (CHF) for Switzerland (VAT included). They are denominated in Euros (€) for Europe, in Pounds Sterling (£) for the United Kingdom and in Dollars ($) for the United States, excluding customs fees and other taxes.

The customer shall directly pay our carrier customs fees and other taxes.

Guillot SA reserves the right to modify its prices at any time but the Products will be invoiced on the basis of the rates in force at the time the order is placed, within the limits of available stocks.

8- ORDER

The Customer wishing to place an order must:

  • Fill out the online order form after selecting the items according to the path indicated. The Customer has, at any time, the possibility to go back to modify or cancel his selection.
  • Fill in the necessary information to send your order (contact details and delivery address) or connect via your personal account.
  • Validate the order after having verified it
  • Agree with the present general conditions of sale
  • Proceed to payment according to the payment conditions provided in the article below.

Any order placed on behalf of a third party without their consent and any fraud resulting in a financial loss for Guillot SA will be reported to the police.

Guillot SA reserves the right to modify prices and correct incorrect prices for any order, as well as for any finalized sale. If a price is obviously incorrect, Guillot SA may be forced to cancel the purchase and refund the amount paid in the best way. This procedure can be performed at any time.

 

 

9- PAYMENT

Payment for the Products is due on order and must be made via a PayPal account or by credit card through Guillot’s online payment platform to which the Customer will be automatically redirected.

 

An invoice will be automatically sent by email to the Customer after his order. A paper version will also be sent in the package containing the Product.

 

If it is a gift, it is possible to ask for an invoice without price at the time of the order.

 

 

10- RESERVATION OF OWNERSHIP

Guillot SA remains the full owner of its Products until full payment.

 

 

11- SHIPPING AND DELIVERY

The deliveries are ensured by the services of TREMAIL Logistics, from Monday to Saturday, according to the option chosen by the Customer at the time of the validation of his order.

 

“Delivery” means the transfer from Guillot SA to the Customer of physical possession of the Products.

 

The applicable delivery charges are those made available to the Customer on the website at the time of the order in the “Delivery and returns” section.

 

When Guillot SA is in charge of the delivery of the Products, the risk of loss or deterioration of the Products is transferred to the Customer.

 

In certain cases, the risk is transferred to the Customer when the Products are handed over to the carrier when the latter is in charge of the transport and asked by the Customer and not by Guillot SA.

 

The delivery is made to the delivery address indicated by the Customer, insofar as this cannot be other than the address of residence of the Customer, a third person or his company. No deliveries will be made to hotels or PO boxes.

 

In the event of impossibility to carry out a delivery, due to an erroneous address or to the non-withdrawal of the Products by the Customer near the point relay which this last chose at the time of the order, no forwarding could be carried out and the Customer will be refunded within five days, as from the date of reception of the order by Guillot SA.

 

In order for delivery times to be met, it is imperative that the Customer has provided accurate and complete information regarding the delivery address, including: street number, building, staircase, access code, names and/or intercom numbers, floor…).

 

Guillot SA cannot be held responsible for any delay in the delivery of the Products that is not its fault or justified by a case of force majeure (as defined below).

 

If the delivery time is exceeded, the Customer may request cancellation of the sale and obtain within a maximum of fourteen days after his request, reimbursement of the sums paid for the purchase of the Products ordered. Guillot SA cannot be held responsible for damages resulting from late delivery and only the refund of Products ordered can be made and any other claim for compensation cannot be heard.

 

 

12- RIGHT OF WITHDRAWAL, REFUNDS AND RETURNS

The Customer has a period of 14 days from the day after he takes possession of the goods to withdraw from his order without having to justify a reason or pay a penalty. Beyond this period of 14 days, the sale is firm and final. The Customer may also exercise his right of withdrawal before shipping his order.

 

It is then the Customer’s responsibility to return the Product to Guillot’s address listed in the Customer Service article below.

 

Before any return, it is important to note that the Customer must imperatively inform Guillot SA Customer Service by email and wait for his return before starting any procedure of return of the Product.

 

The Product must be complete, in its original packaging and accompanied by a copy of the purchase invoice indicating the reason for refusal on the delivery note or invoice.

 

When the Product is addressed to a third party, the latter may only request an exchange. No refund can be made to the third party recipient in the event of a price difference. The Customer retains his right of withdrawal in all cases.

 

The Product is then refunded to the Customer within fourteen days using the same means of payment as that used by the consumer for the initial transaction, following the date on which the withdrawal was requested. Beyond this term, the amount due shall bear interest at the legal rate in force. Refunds are made by crediting the credit card with which the Customer paid for the Product.

 

The shipping costs for a return within the trial period and those for a return under a warranty or repair claim (for defects that appeared after the use of the item by the buyer) are borne by the buyer. In case of revocation by the buyer within the trial period, Guillot SA will credit the buyer with the amount of the item within 14 days of receipt of the return (return fees are not refunded). Any amount due following the return of an item will be credited to the account that the buyer used to pay for the initial order.

 

If the buyer wishes to use his right to revoke the contract and cancel his order, while the buyer’s order has already left Guillot SA’s warehouse (which will generally occur on working days as soon as the buyer has placed his order) – even if the shipment has not yet arrived at the shipping address indicated by the buyer – the costs of returning the item to Guillot SA’s warehouse will be borne by the buyer. If customs duties, import duties or (administrative) charges are due because the shipment was imported into the country of shipment selected by the buyer (a process that, in most cases, cannot be stopped once the package is en route to the country of shipment selected by the buyer), these charges will be borne by the buyer. On the date Guillot SA credits the buyer, Guillot SA will deduct customs taxes, import duties and/or (administrative) fees, to the extent that these amounts have been invoiced to Guillot SA (as sender of the package).

 

The right of withdrawal stipulated in this article does not apply to custom-made watches that the customer personalizes by choosing one or more technical or dimensioning options proposed when ordering.

 

Individual customers have the option of returning the order within 30 days from the date of receipt.

 

This duty is only applicable when the Product and its original packaging can be returned in the condition in which they were received. Any customer wishing to use his right of return must contact Guillot SA to inform him.

 

Return shipping costs are the responsibility of the customer. If a Product is damaged during transport, Guillot SA must be contacted within 30 days to obtain information regarding compensation.

 

 

13- WARRANTY

The Products benefit from the legal guarantee of conformity. This guarantee must be invoked by the Customer within two years from delivery.

 

The Products also benefit from the guarantee against hidden defects. This guarantee must be invoked by the Customer within two years from the discovery of the defect.

 

The warranty does not apply in case of:

  • Faults or damage resulting from improper use (scratches, falls, shocks, bounces, crushing, bumps, etc.);
  • Breakdowns or damage due to unjustifiable repair or modification;
  • Inattention;
  • Intentional damage;
  • Normal wear or ageing of the materials used;
  • Negligence;
  • If the warranty cannot be provided with the watch;

 

In the case where the date of purchase or the point of sale are not indicated on the delivery note or rewritten by hand.

 

This guarantee ensures that you can receive a free replacement, in accordance with these general conditions of use and within the prescribed period and does not restrict any legitimate right of the customer.

 

 

14- RESPONSIBILITY

Guillot SA is held under the online sales process to an obligation of means; its liability may not be incurred for damages resulting from the use of the Internet network such as loss of data, intrusion, virus action or service disruption.

Guillot SA shall not be liable for the non-performance or improper performance of this online sales contract if this is attributable either to the consumer, to the unforeseeable and insurmountable fact of a third party, or to a case of force majeure.

15- INTELLECTUAL PROPERTY

All the elements making up the Guillot SA online boutique are and remain the exclusive property of Guillot SA.

 

No one is authorized to represent, reproduce or reuse for any purpose whatsoever, even partially, elements of the website whether they are software, visual or sound.

19- ARCHIVING – PROOF

Guillot SA will archive purchase orders and invoices on a reliable and durable medium constituting a true copy in accordance with the law.

 

Guillot SA’s computerized records will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.

 

 

20- APPLICABLE LAW

In case of dispute, only Swiss law is applicable, the parties electing domicile in case of dispute before the Courts of Sierre.

 

The parties undertake prior to any contentious action to initiate an informal but real conciliation procedure.

 

 

21- LANGUAGE

In the event of a translation of these general terms and conditions into one or more languages, the language of interpretation shall be French in the event of a contradiction or dispute as to the meaning of a term or provision.
